In the Bahamas, a trade mark is a distinctive sign that identifies particular goods produced or provided by an individual or an entity. Presently, there is no provision for the registration of service marks in our jurisdiction. Registration is for a period of 14 years, but is renewable. Please note that a Convention Priority application must be filed within six months of the priority date.
A trade mark may consist of: combination of words, letters and numerals; an invented word or invented words; a device, brand, heading, label, ticket, name, signature; the name of a company, individual or firm represented in a special or particular manner; the signature of the applicant for registration or some predecessor in his business; or a word or words having no direct reference to the character or quality of the goods.
